Illinois Department of Revenue: Hemp Product Changes, Effective November 12, 2026
The Illinois Department of Revenue has issued guidance to all businesses that possess or sell consumable or topical hemp products in Illinois. The State will begin enforcing the Illinois Hemp Act on November 12, 2026, regardless of the federal December 11 date. Products above 0.4 mg total THC per container will be treated as cannabis and may be sold only by licensed dispensaries. IDOR recommends that businesses review their inventory now and plan returns or redistribution before November 12.
