SERVING SIZE — The marketplace currently offers a wide-variety of serving sizes for hemp-derived THC. This can cause significant confusion for the consumer, retailer, and distributor. The Hemp Beverage Alliance strongly supports the following serving sizes:

  • < 10mg of hemp-derived THC.

  • < 30mg of hemp-derived CBD.

AGE LIMIT — The Hemp Beverage Alliance supports age limits for consumption of hemp-derived products:

  • 21+ for hemp beverages containing THC

LABELING — In the absence of federal regulation, it is incumbent on the industry to create and encourage product labeling that empowers consumers to make informed purchases. The Hemp Beverage Alliance strongly supports the following labeling elements:

  • Cannabinoid levels on front panel

  • FDA disclaimer

  • Medical and pregnancy warning

  • 21+ icon for hemp-derived THC; 18+ for hemp-derived CBD

  • Hemp-derived THC icon

  • Delayed effects warning language ("start low, go slow")

  • Link to Certificate of Analysis (URL or QR code)


REGULATORY CLARITY — In the absence of federal oversight, individual states must create regulatory frameworks that protect consumers and encourage commerce.

MARKETPLACE CONSISTENCY — The Hemp Beverage Alliance strongly encourages state governments to work together to create clear guidelines that are consistent across state lines.

TAXATION — The Hemp Beverage Alliance supports reasonable taxation structures consistent with those of the beverage alcohol industry.
